All within 24 hours.<\/p>\n<p>After 250 \u201cmass shootings\u201d (four or more victims) in 2019, there\u2019s no defense for classical liberals or libertarians to not question their current understandings of the Second Amendment.<\/p>\n<blockquote><p>A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.<\/p><\/blockquote>\n<p>Yes, there\u2019s a Second Amendment\u2026 along with its confusing syntax and complicated history. <a href=\"https:\/\/www.tameri.com\/wordpress\/almostclassical\/2004\/03\/14\/second-amendment-language\/\">I wrote about this topic in 2004<\/a>, and nothing seems to change.<\/p>\n<p>Here\u2019s the thing\u2026\u00a0<strong>The Constitution can be amended.<\/strong> It has been amended <a href=\"https:\/\/www.tameri.com\/wordpress\/almostclassical\/bill-of-rights\/further-amendments\/\">27 times<\/a>. We\u2019ve needed some of the changes for clarity, and some of those clarifying changes have still required yet more legal action because some states chose to ignore the words and spirit of those amendments.<\/p>\n<p>It is possible that the Second Amendment\u2019s language, history, and political biases make it necessary to revisit and, yes, amend the document.<\/p>\n<p>In 2004, I wrote:<\/p>\n<blockquote><p>\u201cA well-regulated militia\u2026\u201d reads the Second Amendment. Does anyone know what \u201cregulated\u201d means? It\u2019s not what most people assume it means. \u201cRegular\u201d meant well-prepared, or well-equipped, and ready at all times. A standing army. Hence, a \u201cregular\u201d army is better than a \u201cguard\u201d on-call. Regulated does not mean \u201cgoverned\u201d in all instances, just as \u201crun\u201d does not always mean something people in track meets do. \u201cRegulated\u201d can mean \u201cwell-prepared\u201d or \u201cwell-maintained\u201d or even \u201cwell-regarded\u201d in eighteenth-century English.<\/p>\n<p>Although one group can insist the constitution applies to a \u201cprofessional and regulated standing army,\u201d another would point to the notion of a \u201cwell-equipped temporary brigade.\u201d Militia meant \u201cstanding army\u201d as often as \u201ctemporary corps\u201d in the literature of the time.<\/p><\/blockquote>\n<p>Increasingly, no matter how I reflect on the language, I\u2019m not convinced the Second Amendment means every sane, stable person has the right to any weapon he or she deems necessary for the security of the state. But that doesn\u2019t matter. The amendment needs to be superseded by something clearer and more aligned with our contemporary realities.<\/p>\n<p>What constitutes \u201cinfringing\u201d on gun rights is the source of our political arguments. Most people agree that you can infringe on the rights of convicted felons and those with documented mental health issues. Is it infringing to limit the numbers and types of guns one can own? You cannot randomly buy a tank, a rocket launcher, or some smaller but equally outrageous weapons. These are \u201carms\u201d that you cannot keep and bear.<\/p>\n<p>Would it be \u201cinfringing\u201d to require a license for gun ownership? Not per gun, but per individual? It seems reasonable to require training and certification before allowing someone to own a weapon.<\/p>\n<p>Here\u2019s the problem.\u00a0<strong>I current leaders could not compose a simple, clear, new Amendment to the Constitution<\/strong> that would maintain some gun rights with limitations a supermajority of states would endorse.<\/p>\n<p>We\u2019re stuck with the current Second Amendment, which means confusion and a lack of progress on meaningful gun limitations.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Paso.
